These Terms of Service (the “Terms”) govern your access to and use of the Dirty Civilian website and your purchase of products from our online store. Dirty Civilian sells purpose-built gear for the capable civilian, including apparel, headwear, everyday-carry (EDC) gear, and preparedness gear. Please read these Terms carefully. By using our website or placing an order, you agree to be bound by them.

1. Acceptance of Terms

By accessing or using this website, browsing our catalog, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the website or place an order. These Terms constitute the entire agreement between you and Dirty Civilian regarding your use of the website and supersede any prior understandings on that subject.

2. Eligibility

To place an order, you must be the age of legal majority in your state or jurisdiction of residence and able to form a binding contract. If you are a minor under the applicable age of majority, you may use the website and make purchases only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. By placing an order, you represent that you meet these requirements and that the information you provide is accurate and complete.

3. Your Account

You may be able to create an account to place orders or manage your information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it updated. Notify us promptly at support@dirtycivilian.com if you suspect any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.

4. Products, Descriptions, Colors, and Availability

We work to describe and display our products accurately. However, we do not warrant that product descriptions, images, colors, pricing, or other content on the website are complete, current, or error-free. Colors and finishes may vary depending on your device and screen settings, and actual products may differ slightly from their images. All products are subject to availability, and we may discontinue, change, or limit the availability of any product at any time without notice. We reserve the right to correct any errors, inaccuracies, or omissions and to update information at any time without prior notice, including after an order has been submitted.

5. Pricing, Orders, and Payment

All prices are listed and charged in U.S. dollars (USD) and are subject to change without notice. Applicable taxes and shipping charges are calculated and displayed at checkout.

Your submission of an order is an offer to purchase. All orders are subject to acceptance by us, and we reserve the right to refuse, limit, cancel, or reject any order for any reason, including limiting quantities purchased per person, per household, or per order; suspected fraud or unauthorized activity; or errors in pricing or product information. In the event a product is listed at an incorrect price due to a typographical, pricing, or other error, we reserve the right to refuse or cancel any order placed for that product, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged and we cancel your order, we will issue a refund in the amount of the charge.

By providing a payment method, you represent that you are authorized to use it and you authorize us and our payment processors to charge it for the total amount of your order, including taxes and shipping. Payments are processed by Shopify Payments and/or other third-party payment processors, and your use of those services may be subject to their own terms. We do not store full payment card details on our own systems.

6. Shipping and Delivery

We ship within the United States only. Shipping rates and delivery estimates are described on our website and calculated at checkout. Delivery timeframes are estimates only and are not guaranteed.

Certain hazardous-materials items cannot be shipped by air; such items are identified on their product pages. If your order is lost, stolen, or damaged in transit, we will work with you to make it right as described in our Shipping Policy. For full details, please review our Shipping Policy.

7. Returns and Refunds

Returns, exchanges, and refunds are governed by our Refund & Return Policy, which is incorporated into these Terms by reference. Please review that policy for details on eligibility, timeframes, and how to request a return.

8. Intellectual Property

The website and its contents—including the “Dirty Civilian” name and logo, other trademarks and brand marks, text, graphics, product designs, photographs, images, and the selection and arrangement of all content—are owned by or licensed to Dirty Civilian and are protected by U.S. and international intellectual property laws. You may not copy, reproduce, republish, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the website or its content without our prior written consent. Trademarks, product names, and logos of third-party brands featured on the website are the property of their respective owners and are used for identification purposes only; their appearance does not imply any endorsement or affiliation.

9. Third-Party Brands, Products, and Links

In addition to our own apparel and gear, we resell products manufactured by third-party brands (for example, Magpul). Third-party products are sold on an “as-is” basis and are covered only by the manufacturer’s warranty, if any, offered by that brand. Dirty Civilian makes no independent representation or warranty regarding third-party products and disclaims all warranties on such products to the fullest extent permitted by law. Any warranty claims, service, or support for third-party products may need to be directed to the manufacturer in accordance with its terms.

The website may contain links to third-party websites or resources that we do not own or control. We provide these links for convenience only and are not responsible for the content, products, policies, or practices of any third-party site. Your use of third-party sites is at your own risk and subject to their terms.

10. Acceptable Use

You agree to use the website only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable law, regulation, or third-party right;
  • Use the website or products for any fraudulent, unlawful, or unauthorized purpose, or resell products in violation of applicable law;
  • Submit false, inaccurate, or misleading information, or use another person’s payment method or identity without authorization;
  • Attempt to gain unauthorized access to the website, other users’ accounts, or any systems or networks connected to the website;
  • Introduce viruses, malware, or other harmful code, or interfere with or disrupt the operation, security, or integrity of the website;
  • Use any robot, scraper, or other automated means to access, copy, or collect data from the website without our permission;
  • Infringe our intellectual property rights or those of any third party; or
  • Harass, abuse, threaten, or harm any other person, or post unlawful or objectionable content.

We may suspend or terminate your access to the website, and refuse or cancel orders, if we believe you have violated these Terms.

12. Limitation of Liability

14. Force Majeure

We are not liable for any delay or failure to perform our obligations, including processing, shipping, or delivering your order, caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic or pandemic, labor disputes, carrier delays or disruptions, supply or inventory shortages, utility or telecommunications failures, cyberattacks, acts of government, or civil unrest. If such an event occurs, we will make reasonable efforts to notify affected customers and to resume performance as soon as practical.

15. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them, the website, or any product are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding will be brought exclusively in the state or federal courts located in the State of Tennessee, and you consent to the personal jurisdiction and venue of those courts. Any claim must be brought within the time period allowed by applicable law. Nothing in this section limits any consumer rights that cannot be waived under applicable law.

16. Severability and Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
